Constitutional Referendum to Amend General Assembly Meeting Requirements of the Legion of Black Collegians Senate

October 14, 2010

Purpose: To amend Article VII, General Assembly of the constitution to adhere to actual processes acted upon by the Legion of Black Collegians Senate.

Whereas, all senate meetings are open to the senators, administrations, the undergraduate student body-at-large, as well as the community and,

Whereas, Umbrella Organizations rely on a schedule of senate meetings in order to present to senators in a timely manner for their events to take place and,

Whereas,  Announcements consisting of information of all programs, events and meetings, given by Senators, Umbrella Organization representatives and Executive Board Members  are given every senate body meeting and,

Whereas, the definition of the General Assembly as stated in this constitution show little difference to what now stands as senate meetings and,

Whereas,  the time dictated by this constitution to hold General Assembly meetings as history denotes is more effectively used as a Senate Meeting and,

Whereas, General Assembly meetings are useful when at the beginning of the fall and winter semesters before senators are selected,

THEFOREFORE BE IT ENACTED BY THE LEGION OF BLACK COLLEGIANS SENATE to increase the productiveness of senate, and as to not interrupt the efficiency of  senate while adhering to constitutional law, shall Article VII be amended as follows:

Article VII.  GENERAL ASSEMBLY

The General Assembly is if the Legion see fit to host one is to serve as a constituent information of which all programs, events, and meetings are announce, questions and comments of LBC members are heard and government division reports are given as directed by Article IV, Section 4, and Article V, Section 3.

SECTION 1. AUTHORITY

The General Assembly shall have all powers, incidental and necessary, in the supervision and oversight of the action of LBC and review of policies and recommendations.

SECTION 2.  MEMBERSHIP

The General Assembly shall consist of all undergraduate students currently enrolled at the University of Missouri-Columbia.

SECTION 3.  MEETINGS

The LBC President shall preside at all assembly meetings.  The General Assembly shall convene during the first week of the fall and winter semesters and at the discretion of the Legion of Black Collegians Executive Board ruing the first week of each month during the fall and winter semesters.

A.  Special meetings may be called only by the LBC President.

SECTION 4.  PROCEDURE

The General Assembly is to serve the primary purpose of informing all LBC members.  It shall not be a policy-making body.  All decisions, proposals, and ideas are to be facilitated through the governments divisions of Executive Board and/or Senate as directed by this Constitution

Constitutional Act to Change Membership Qualifications of the Legion of Black Collegians Senate

Purpose: To allow better representation of students in the Legion of Black Collegians Senate as well as increase senatorial participation among the Legion.

Whereas, students are unaware of the powers invested in them as senators and

Whereas, structure in senate is needed in order to lawfully handle Legion of Black Collegian business, increase retention, and to further educate senators on the role they play in the Legion and

Whereas, the process of senatorial elections as currently stated in the Constitution are without clarity, and lack proper screening procedures for senators and

Whereas, students, executive board and senators, wish to see Senators held more accountable and hold more responsibility in their role of senators .

THEFOREFORE BE IT ENACTED BY THE LEGION OF BLACK COLLEGIANS SENATE for the betterment of the Senate and betterment of the student body at large, Article V. Section 2 be amended as follows:

SECTION 2. MEMBERSHIP

The Senate shall consist of undergraduate students of the University of Missouri-Columbia who meet the requirements of the LBC Constitution at the time of their election and throughout their terms on the Executive Board.  The Senate Secretary shall have the authority to demand proof of compliance with this law.

A.  Residence Halls, National Pan-Hellenic Fraternities and Sororities of MU, and umbrella organizations including but not limited to all African-American academic and social organizations that are officially recognized by the university.

1.1    Authorization

All MU National Pan-Hellenic fraternities and sororities, umbrella organizations, are entitled to appoint one (1) senator. All classes of the university (freshman, sophomore, junior and senior) are required to have at least one (1), yet nor more than three (3) senators.

1.2    Selection

All Senators selected from the unites in Article V, Section 2, subsection A-1.1 of this constitution shall be selected in the fall semester of each academic year and thereafter as vacancies occur.

1.3. Process

Students interested in a senator seat shall apply and adhere to interviews with members of the executive board, including but not limited to the Vice President.

B.  Off-Campus Senators

1.1    Authorization

All students living in any housing not listed in Article V, Section 2, subsection A-1.1 of this constitution shall be entitled to a seat in accordance with Article V, Section 2, subsection B-1.2.

1.2     Election

All Senators authorized in Article V, section 2, subsection A-1.2 of this constitution shall be considered elected for the current senate term after having submitted a senate application to the senate secretary and having been selected by the Speaker of Senate.

C.  Senators-at Large

1.1    Authorization

Any LBC member shall be entitled to be a senator at-large provided that the total number of senators-at-large does not exceed 5% of the undergraduate enrollment.

1.2    Election

Each candidate for senator-at-large shall place his or her name in nomination at the second LBC Senate meeting of the semester.  Under the discretion of the Executive Board, the election will take place, after each candidate has been given the opportunity to speak before the Senate for no longer than one (1) minute.  There shall be no campaign spending.  A senator shall be elected by plurality of the vote of the Senators present.  Senators-at-large must be elected to the Senate no later than the third meeting of the semester.
